The contest rules only say that your model can't be something you've made before (for background stuff this is fine). So technically, it's okay to make something that someone else has made, since you'd be re-making it. There's no requirements for the concept to be original. He might lose some points for a lack of creativity (if it's judged on that, which we don't know) but I would say he's certainly not breaking any rules here.
