Flatten brush bug? Brush works differently if using tablet than if using mouse

when using tablet, the flatten brush changes its orientation over the stroke even if pick initial or view normal settings are selection in brush options.

here is an example of the flatten brush being used with the mouse:

And then the tablet:

 

The desired behavior in my case would be that the tablet mode works like the mouse mode
